The water charge in agriculture as a social water management instrument. A case study in the Rio Cubatao watershed. Catalano, Maria Raquel*,1, Christofidis, Marina1, 1 Universidad Federal de Santa Catarina, Florianopolis, Santa Catarina, Brasil ABSTRACT- Coherent with the present concepts of the social management of water as public property, the Federal Brazilian Law n?. 9.433, of 08 of January of 1997, instituted in Brazil the National Policy of Hydric Resources and National System of Hydric Resources, This law being constituted by foundations, objectives, directives and instruments. For effects of that work, it emphasized as a foundation that the river basin would be considered the unit of planning and management with the participation of the society, allowing the mediation and the dialogue in the process of sustainable management of the water. As instruments of management of the water the law as a legal device establishes plans, classification of the rivers, grants of the rights of the water, water charges and an information system on hydric resources. Considering the existence of the application of the charging for the use of the water in agriculture in several countries, that work presents a compared study between experiences of Latin America and Europe, which intends to propose a model to be applied in the Cubatao Watershed, located in the state of Santa Catarina, Brazil, al that considering the reality and specificities, as well as the participation of the people who live in the river basin. The methodology applied was the exploratory search, using the indirect observation as a technique of collection of data through a bibliographical revision following the suite stages: the verification by the organisms of the watershed management of the existing models of the charges, getting used to the variables inserted in the process such as the study of its social and economic justifications, this is done for each model of charging and then is determined which of the possible criteria for a simulation sighting to suggest a specific model for the river basin of the Rio Cubatao. SPANISH ABSTRACT- Coherente con los actuales conceptos de la gestion social del agua como un bien publico, la Ley Federal n. 9.433, de 08 de Janeiro de 1997, institui en Brasil la Politica Nacional de Recursos Hidricos y cria el Sistema Nacional de Recursos Hidricos, incorporando fundamentos, objetivos, directrices e instrumentos. Para efectos de ese trabajo, destacase como fundamento la cuenca como unidad de planeamiento y gestion con la participacion de la sociedad, permitiendo la mediacion e el dialogo en el proceso del aprovechamiento sostenible del agua. Como instrumentos de gestion del agua, ese dispositivo legal establece planes, encuadramiento de los rios, otorga de los derechos del agua, cobranza e un sistema de informacion sobre recursos hidricos.Considerando la existencia de la aplicacion del pago por el uso del agua en la agricultura en varios paises, ese trabajo presenta un estudio comparado entre experiencias de la America Latina y Europa, con vistas a proponer un modelo a ser aplicado en la Cuenca del Rio Cubatao, localizada en el estado de Santa Catarina/BRASIL, levando en cuenta su realidad y peculiaridades, asi como la participaciin de la gente que vive en la cuenca.La metodologia aplicada fue la pesquisa exploratoria, utilizandose la observacion indirecta como tecnica de coleta de datos, concretizada tanto por una revision bibliografica, cuanto siguiendo las siguientes etapas: la verificacion junto a los organismos de cuenca de los modelos del pago ya existentes, criando una intimidad con las variables utilizadas nos mismo, estudio de las variables y las justificativas sociales y economicas para el pago por el uso del agua dentro de cada un de eses modelos y determinacion de los criterios posibles para una simulacion visando ayustar las variables y definicion de un modelo especifico para la cuenca del Rio Cubatao. |
