(52-21) Regulation of implementation of the environmental risk assessment mechanism in Russian environmental legislation.

ABSTRACT- Risk assessment could be a very important mechanism of environmental problems reduction in Russia. Risk assessment implementation has to be reflected in national environmental legislation to mechanism reinforcing. First, risk assessment is used at the stage of environmental expertise of projects and documents to determine their fulfilment of environmental requirements (as ruled by the Federal Law "About environmental expertise" and regional laws). It is then necessary to carry out environmental risk assessment in environmental audit execution (there is no corresponding federal legislation, but some regional laws were adopted). There is also a special form of environmental risk assessment for environmental insurance conducted both at the stage of primary evaluation of possible risk and at the stage of damage compensation. It is not reflected in the federal legislation but ratified in few regions, so the implementation of risk assessment is partly regulated by the federal legislation. The "blank" spaces in the environmental law, existing at the federal level, are fulfilled at the regional level. This process, however, takes place only in few parts of the country. Modern Russian environmental legislation has been created anew during last ten years of the "transitional period". It is rather insufficient. Even adopted normative acts often do not work due to imperfections in the mechanisms of their implementation.
